Arc Electric Inc warrants that
workmanship provided hereunder shall be free from defects for 5 (five) years
from the date of substantial completion. Should any equipment, part, or
component provided prove defective, Arc Electric Inc will assign to the
customer any assignable limited warranties provided by the manufacturer. In no
event shall Arc Electric Inc’s liability under this agreement exceed the
agreement sum. Arc Electric Inc, at its sole option, shall repair, replace, or
issue credit for any defective item(s) covered under the above warranty,
provided such items were not damaged, abused, misused, tampered with, or
affected by chemical properties, and this shall be the customer’s exclusive
remedy for breach of warranty under this agreement. To obtain performance of
the Arc Electric Inc limited warranty, contact Arc Electric Inc. at 1908 Green
Oaks Pkwy. Holly Springs, 27540 or call (919) 888-3500. No claim for defective
workmanship may be brought or cause of action filed unless customer has
provided Arc Electric Inc. with written notice of the alleged defect within 30
days of occurrence. CUSTOMER AGREES THAT THIS LIMITED WARRANTY EXCLUDES ANY
REMEMDY FOR DAMAMGE OR DEFECT CAUSED BY ABUSE AND/OR MODIFICATIONS NOT
PERFORMED BY ARC ELECTRIC INC. IMPROPER OR INSUFFICIENT MAINTENANCE, IMPROPER
OPERATION, AND NORMAL WEAR AND TEAR UNDER NORMAL USAGE. ARC ELECTRIC INC
EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. All warranty work must be
done by Arc Electric Inc. Customer will not be compensated for work done by
other companies. All warranty work shall be done during normal business hours
(8a.m. to 5p.m. weekdays). Customers will be charged for warranty work done
other than normal business hours.

Arc Electric Inc. recommends annual maintenance and periodic inspections. Failure to follow manufacturer’s instructions will void warranties. Other companies or persons performing service on Arc Electric Inc’s equipment shall void warranties.
