9. DISCLAIMERS:

ARC does not cover repairing drywall, trim, and/or paint that may be damaged or opened for the quoted work

If you accept a quote for repairs to be done which requires parts to be ordered and subsequently you choose to not have the repairs done after the part(s) is already ordered, we will have to charge a $25.00 non-refundable re-stocking fee.

TRENCHING:

When digging, the homeowner is responsible for marking sprinkler systems, down spout drains, and any other lines not marked by 811. Damage to sprinkler systems and drains that have not been marked are the homeowner’s responsibility.

There is a 5 year warranty for parts and labor, if the issue was poor workmanship on the part of ARC.

10. WARRANTIES:

If the defect is a part defect, part warranty will depend upon the part supplier/manufacturer. ARC will cover the labor to replace the defective part for 5 years after installation. This warranty is void If the defect is determined to be a result of a fault caused by improper use or unforeseeable circumstances outside ARC’s control

There is a 5 year warranty for parts and labor, if the issue was poor workmanship on the part of ARC.

11. Payment Terms:

Unless the TERMS field states otherwise, payment is due upon job completion (DUE ON RECEIPT). Completion is defined as the last day of work performed and does not include inspection date. Any special billing terms required by client’s billing department must be brought to ARC’s attention prior to the start of any job. Credit card payments shall be subject to a merchant services fee if the total amount exceeds $1,500 in addition to the invoiced amount.

There is a twenty-five-dollar ($50.00) fee for any check(s) bounced or credit card stop payment. Any additional costs incurred by ARC for check or credit card payment issues, including merchant service fees, or any payment issues that cause financial loss or delay in payment, including but not limited to

reasonable attorney’s fees, shall be the responsibility of the contracted client and will be added to the amount due.

Payments due on DUE ON RECEIPT are delinquent 24 hours after completion if not paid. For all other payments other than DUE ON RECEIPT and not made within ten (10) days of the due date on terms are considered delinquent. All delinquent contracts are subject to a finance charge of 1.5% per month (18% APR) on the unpaid balance, until paid in full. Failure to pay is considered breach of contract and may result in a Mechanic’s Lien being placed on the property. This means if a lien is filed, your property could be sold against your will to pay for labor, materials, or other services that you or your contractor or subcontractor may have failed to pay. Lien law is complex, and it is recommended that whenever a specific problem arises, you consult an attorney.
